ChatGPT vs Google Gemini: which fine print is kinder to you?

Short answer

Gemini wins on price if you already pay Google for storage, since AI Pro bundles 5 TB and more. ChatGPT wins on terms: OpenAI assigns you the rights in the output, and its training opt-out keeps your history, while Gemini keeps chats that human reviewers have seen for up to three years, even after you delete them.

What users sayB App users rate ChatGPT highly (4.8 from about 11.9 million App Store ratings, 4.8 on Google Play, 4.9 from 762 Product Hunt reviews, 4.6 on G2 and 4.5 on Capterra), while Trustpilot is harsh at 1.6 from 3,921 reviews. The most repeated complaints are usage limits that run out fast, billing and cancellation trouble, and answers that invent details or ignore instructions. The most repeated praise is everyday versatility: study help, writing, brainstorming and quick answers.C Opinion is split: app stores and business-review sites are positive (4.7 from about 2.4 million App Store ratings, 4.6 on Capterra, 4.5 on Google Play, 4.4 on G2), while Trustpilot sits at 1.4 from 1,436 reviews. The most repeated complaints are confident wrong answers and instructions or earlier details being ignored, plus weak voice-assistant replacement for Google Assistant. The most repeated praise is fast everyday answers and tight Google integration.
Pricing clarityB US prices are published, but not where you would expect. The pricing page adapts to your country and can show local currency, so the clearest dollar figures are in OpenAI's help center. There, Plus is $20/month, Pro tiers are $100, $200 and $500, and Business seats are $25 monthly or $20 billed annually. Go is quoted at $8 as an indicative US price that varies by market. Personal plans are monthly only, the terms say taxes are added where required, and Business requires at least two paid seats.B The US subscriptions page lists every personal plan in dollars: AI Plus $4.99, AI Pro $19.99, and Ultra at $99.99 or $199.99 depending on whether you take 5x or 20x AI Pro usage. The plans are bundles, so storage, YouTube and Google Home perks come in the same price, which helps if you would buy them anyway. Google notes that local prices vary and that you must be 18 or older for Google AI plans. The page we read shows no annual option.
Cancel & refundsC You can cancel any time and keep access to the end of the paid period, but the help center states that payments are generally non-refundable. A discretionary refund may be granted on an individual plan if you ask within seven days of the charge and have made no substantial use. Forgetting to cancel, dissatisfaction or a plan change do not qualify on their own, and there is no prorated refund after day seven. EU, UK and Turkey residents get a prorated refund within 14 days. Unused Business seats are generally not refunded for the committed period.D The subscriptions page says you can cancel anytime but gives no refunds for partial billing periods, except where the law requires it. The Google One terms add that you keep access until the end of the current billing period and that refunds go through the seller's refund policy. Neither page sets out a refund window for US customers.
Limits & creditsC No plan publishes a fixed message count. Plus 'may include usage limits such as message caps' that vary with demand, and 'unlimited' Pro access is subject to abuse guardrails. Speed modes eat your allowance faster: Fast mode counts at 2.5 times the standard rate and Ultrafast at 8 times. Credits bought on personal plans are valid for 12 months and then expire without rolling over. The API credits bundled with Pro expire at the end of each billing cycle, according to the pricing page footnote.C Gemini moved to compute-based limits that refresh every 5 hours until you hit a weekly cap. How much you get depends on prompt complexity, the features you use and how long the chat runs. Paid tiers are defined only as multiples: 2x and 4x the standard limit for AI Plus and AI Pro, and 5x or 20x AI Pro for Ultra. Media generation, Deep Research and the Pro model use the allowance faster. The Google One terms say AI credits can expire after a period set when you acquire them and may be forfeited if you cancel.
Your dataC On personal Free, Plus and Pro workspaces, 'Improve the model for everyone' is on by default, so your chats can train OpenAI's models until you turn it off. The opt-out is easy and keeps your history, but a thumbs-up or thumbs-down can still send that whole conversation to training. Voice mode and Codex environments have their own separate training switches. Temporary chats are not used for training and may be kept up to 30 days for safety. Business, Enterprise and Edu workspaces are not used for training by default.D While Keep Activity is on, Google says it uses your activity to provide and improve its services, including training generative AI models, with help from human reviewers. Activity auto-deletes after 18 months by default, and you can change that. Chats seen by reviewers are disconnected from your account and kept for up to three years, even if you delete your activity. With Keep Activity off, or in temporary chats, conversations are held for 72 hours and are not used for training unless you send feedback.
Output rightsA The US Terms of Use say you keep ownership of your input and own the output, and OpenAI assigns to you any rights it has in that output. That applies on every plan, free included, with no watermark or commercial-use carve-out in the terms. The one caveat is that output may not be unique, and the assignment does not cover similar output other users receive.B Gemini Apps are governed by the Google Terms of Service and the Generative AI Prohibited Use Policy. The US terms say that when a service lets you generate original content, Google won't claim ownership over it. That is a promise not to claim ownership rather than an explicit assignment of rights, and the terms add no paid-plan condition for commercial use.
